Common-law Partner

How much income do I need to sponsor my spouse?
There is no minimum income requirement to sponsor a spouse, common-law, or conjugal partner, unless the spouse has dependent children with children of their own. However, you must show that you’re not receiving social assistance and can support your spouse financially.
Can my spouse work in Canada while waiting?
Yes. If your spouse is applying from within Canada (inland sponsorship), they may be eligible for an Open Work Permit while the sponsorship is being processed. This allows them to work legally until a decision is made.
What happens if my application is refused?
If your spousal sponsorship application is refused, you’ll receive a written explanation from IRCC. You may appeal the decision to the Immigration Appeal Division (IAD) if the application was submitted outside Canada. Inland applicants do not have a right to appeal but can apply for judicial review.
Can I sponsor my same-sex partner?
Yes. Canada fully recognizes same-sex relationships under spousal sponsorship. You can sponsor your same-sex spouse, common-law, or conjugal partner if all eligibility requirements are met and the relationship is genuine.
